With the legalization of recreational cannabis markets in Uruguay, Canada, and several U.S. states, a breakthrough in conventional cannabis policy is emerging. But legalization is not a binary choice between prohibition and some regulated commercial model (like alcohol). A commercial market is just one of many ways to implement legalization—and moving directly from prohibition to commercial legalization leaps from one extreme to the other. om Decorte, a criminologist and anthropologist at Ghent University (Belgium), who has published numerous articles on substance use, cannabis markets, and local drug monitoring systems, argues that most of us are bypassing other, safer forms of legalization, including the nonprofit model. He explores topics such as:

Regulating Cannabis – a detailed scenario for a nonprofit cannabis market

Developments in European countries are both influenced by and impact on global drug trends. For some synthetic stimulant drugs like MDMA, Europe is a major producer, exporting products and expertise to other parts of the world. For cannabis, European production has to some extent displaced importation and appears to have impacted on the business models of external producers. One consequence of this can be seen in the increased potency of the cannabis resin now being trafficked into Europe. For cocaine and heroin, the two other major plant-based illicit drugs, production remains centred in Latin American and Asian countries, respectively. Global data suggests that for both substances production has been increasing. How this impacts on Europe merits scrutiny. In the case of heroin, despite the relatively high purity of the drug at street level, overall use remains stable with rates of initiation into use appearing to be low. For cocaine, in contrast, several indicators are now trending upwards. This is discussed in more detail below. For both substances however, seizure data suggest some recent changes in the production chain that may have important future implications. Secondary processing and extraction of cocaine from ‘carrier materials’ continues to be observed in Europe, as does the importation of large volumes of the drug concealed in shipping containers. For heroin, a new development is that laboratories converting morphine to heroin have been detected and dismantled in several European countries. The driver of this is likely to be the greater availability and considerably lower cost in Europe of acetic anhydride, a key precursor chemical for heroin production, at a time when opium poppy harvests are increasing. This development illustrates not only the globally joined-up nature of modern drug production networks, but also the need to frame drug control responses, such as precursor controls, within a global perspective.

European drug report 2018: trends and developments

This publication provides an overview of the latest information available on the use of new psychoactive substances (NPS) and related problems in European prisons based on a rapid information assessment carried out by the European Monitoring Centre for Drugs and Drug Addiction (EMCDDA). The study complements data from a range of established sources. The EMCDDA has been routinely collecting data on illicit drug use among prisoners for over 15 years through a combination of qualitative and quantitative monitoring tools, although the primary focus has been on controlled substances. The EMCDDA also collects information on NPS and, in 2017, was monitoring a total of over 670 NPS that have been notified to the EU Early Warning System (EWS). The use of NPS by high-risk drug users has recently been explored by the EMCDDA (2017a). The study found that while consumption levels of these drugs were low overall in Europe, the smoking of synthetic cannabinoids among some marginalised populations, including prisoners, appeared to be an emerging but poorly understood problem in many European countries. This study was prompted therefore by the conclusion that NPS use among prisoners appears to be a rapidly developing phenomenon and there is growing concern in some countries that NPS may be responsible for a large share of drug-related problems in prison, while appropriate responses are mostly lacking. However, empirical data are currently scarce and patchy, as monitoring drug use among prisoners in general, and NPS use in particular, at the European level is challenging due to the different study designs applied and limited systematic data collection. To investigate the extent, nature and impact of these developments the EMCDDA carried out a targeted rapid information assessment between August and December 2017. The aim of the study was to map and increase understanding of NPS use in prisons in Europe, including prevalence and patterns of use, the underlying contributing factors, associated harms and market and supply features of NPS use in prisons, as well as the responses implemented to address NPS-related problems in prison settings.

New psychoactive substance in prison

This review assesses the abuse potential of medically-administered pbisilocyn, following the structure of the 8 factors of the US Controlled Substances Act (CSA). Research suggests the potential safety and efficacy of psilocybin in treating cancer-related psychiatric distress and substance use disorders, setting the occasion for this review. A more extensive assessment of abuse potential according to an 8-factor analysis would eventually be required to guide appropriate schedule placement. Psilocybin, like other 5-HT2A agonist classic psychedelics, has limited reinforcing effects, supporting marginal, transient non-human self-administration. Nonetheless, mushrooms with variable psilocybin content are used illicitly, with a few lifetime use occasions being normative among users. Potential harms include dangerous behavior in unprepared, unsupervised users, and exacerbation of mental illness in those with or predisposed to psychotic disorders. However, scope of use and associated harms are low compared to prototypical abused drugs, and the medical model addresses these concerns with dose control, patient screening, preparation and follow-up, and session supervision in a medical facility.

Area under opium poppy cultivation and opium production reached a new record high in 2017 In 2017, opium poppy cultivation increased sharply to an unprecedented record high of 328,000 hectares from an estimated 201,000 hectares in 2016. Between 2016 and 2017, the area under cultivation with opium poppy increased by 127,000 hectares – the increase alone exceeded the levels of annual cultivation of 2009 and 2010.

Opium poppy cultivation increased strongly in almost all major poppy cultivating provinces. In Hilmand province alone, cultivation increased by 63,700 hectares (+79 per cent) which accounted for about half of the total national increase between 2016 and 2017. Strong increases were observed also in Balkh (+10,000 hectares or almost five times more than in 2016), Kandahar (+7,500 hectares or +37 per cent), Nimroz (+6,200 hectares or +116 per cent), and Uruzgan (+6,000 hectares or +39 per cent).

Mainly caused by the increase in area under cultivation but as well due to good yields, potential opium production almost doubled from its 2016 level (4,800 tons) to 9,000 tons in 2017. Accounting for 57 per cent of national production, the Southern region continued to produce the vast majority of opium in Afghanistan, followed by the Northern (16 per cent of national production), Western (13 per cent) and Eastern regions (9 per cent).

In regards to current drug trends, particularly methamphetamine (both in crystal and pill form) has become increasingly accessible and affordable throughout Asia, reflecting the trend of rising use of amphetamine-type stimulants (ATS) in the region.

Governments in the SEA region have implemented different kinds of national drug policy reform, including diversion programmes (Indonesia and Cambodia), harm reduction measures (Malaysia and Myanmar), and steps towards decriminalisation of cannabis cultivation and use for medical and scientific purposes (Thailand).

The scale of illicit cultivation of crops continues to be largely influenced by various socioeconomic and political factors such as poverty, conflict, and weak institutions, both in Myanmar and Afghanistan. In areas affected by conflict, households often grow opium poppy as a means of survival in an environment where markets are not accessible.

Lessons can be learned, for instance, from experiences in Thailand or Colombia. The Thai experience demonstrates the importance of integrated rural development as a foundation of AD measures, addressing short-term needs as well as long-term sustainability. This includes community planning, inclusive value-chain development and sustainable land management, among other aspects. Experiences regarding coca cultivation areas and the recent peace agreement in Colombia confirm that multi-stakeholder dialogue is important for being able to access local communities and building trust.

Regulating and legalising cannabis is an idea whose time has come

The so-called ‘war on drugs’ was always built on shaky foundations. Now countries and jurisdictions around the world are dismantling it piece by piece and starting to build a new drug policy architecture that ushers in a new era of health-based policy making fit for the 21st century.

Nowhere are the foundations of this new approach to drugs more obvious than in the global movement towards regulated, legalised cannabis markets. And despite the US being the ostensible leader of the ‘war on drugs’, it has been US states at the forefront of this move. Since Colorado and Washington states legalised cannabis for non-medical use in 2012, and Uruguay became the first country do so in 2013, seven more US states and the District of Columbia have followed in their footsteps.2 The results so far, particularly from the US, are generally positive: confounding critics whilst bringing in additional tax income to fund public services. And this is just the start: in the summer of 2018 Canada will become the first G7 country to legalise cannabis.

Regulating and legalising cannabis is an idea whose time has come. The UK public supports it too: in recent polls 47% of people support selling cannabis in licensed shops. Regulation also has the support of a range of groups from across the political spectrum.

It is time to accept that prohibition is not only ineffective and expensive,but that regulation could – if it is done well – protect vulnerable groups and promote public health. It would also generate both taxes (at least £1 billion annually, but potentially more) and savings, which taken together would mean more resources for health, harm reduction and other public services. It is time for the UK government to catch up with the global shift and take the responsible approach by bringing in a regulated, legal market for cannabis.

Cannabis: Regulate it. Tax it. Support the NHS. Promote public health.

Drug law enforcement subsumes the majority of drug policy expenditure across the globe. Fuelled by knowledge that much of this investment is ineffective or counter-productive there have been increasing calls for cross-national comparisons to identify where policing approaches differ and what types of approaches may be more effective. Yet, to date cross-national comparison of drug law enforcement has proven a methodologically hazardous affair. Using a new drug policing module added to the 2017 Global Drug Survey, this study seeks to provide the first cross-national comparison of the incidence, nature and intensity of illicit drug-related police encounters amongst people who use drugs.

Thank you for your help in the birth of the Eurasian Harm Reduction Association! 2017 has become almost revolutionary for harm reduction activists in the Central and Eastern Europe and Central Asia (CEECA) region.

Within the association of activists, there has been a challenging process of renovation, the building of a democratic organization with clear processes, and opportunities for activists from all countries of the region to influence the organization’s strategy, policies and activities. It has been possible not only to build a transparent decision-making process, but also to develop an ambitious strategy for our organization through the harmonious and well-coordinated work of the EHRA Steering Committee alongside members and EHRA’s Secretariat. A clear-sighted vision of what is required for sustainable harm reduction programs, and for decent lives of people who use drugs, has helped EHRA to gain strong support from global and regional communities, allies and partner organizations that has encouraged us to build from scratch a solid management system for the organization. From the very beginning of its active operation in 2017, EHRA has already started to implement 9 advocacy projects and has been supporting community groups of people who use drugs in countries of our region; EHRA has also maintained its leadership in regional advocacy to ensure sustainability and efficiency of harm reduction services and for drug policy reform to shift towards being based on public health and human rights.

Now it’s time to mobilize all resources. Drug policy in countries has not improved, but rather has worsened. In most cases, governments are more likely to pay for policemen and prisons than provide social and medical assistance to people who use drugs. In all countries of the region, it has become obvious that we need to change the approach to harm reduction services because the drug scene is changing and people who use drugs are also changing. The issue of government funding of harm reduction services has become very relevant for most of the countries of the CEECA region with international funding rapidly declining and, therefore, EHRA sees its priority in supporting communities in their advocacy for sustainable funding of quality harm reduction services from national sources.

EHRA in 2017: A good start

Subject Recently, the government of Ghana proposed the Narcotics Control Commission Bill of 2017 (NCC) to replace the current Narcotic Drugs (Control, Enforcement, and Sanctions) Law of 1990 (PNDCL 236) that criminalizes all drug-related activities including drug use, possession, trade, and production. NCC aims to decriminalise drug consumption in Ghana. The initiative is a recognition of the grave impact on public health of the country’s current drug legislation, which imposes punitive sanctions on those engaged in the consumption, production, and trafficking. However, the ramifications of legal change could be felt beyond the country as Ghana could become a norm entrepreneur in the region for harm reduction policies.

Analysis Global Trends Historically, national drug policies have taken a punitive approach to suppress the trade in ‘narcotic’ substances in line with the UN-based international drug control conventions, which have arguably contributed to a range of failed policies including Plan Colombia and mandatory sentencing in the United States. After decades of harsh drugs policies, the United Nations Office on Drugs and Crime (UNODC) found in 2015 that about a quarter of billion people from the age of 15-64 consumed illicit drugs. The result of these measures are high levels of drug use and the harms that are associated with them has resulted in a shift in some parts of the world towards legalisation and decriminalisation models. For example, in 2001, Portugal decriminalised drug procession for personal use. In 2017, Uruguay became the first country to legalise cannabis for recreational purposes. Furthermore, 29 states within the United States have legalised the recreational and medicinal use of cannabis. Ghana’s reconsideration of drug laws is in line with this trend through the decriminalisation of Ghana’s Narcotic Control Commission Bill of 2017.

Regional trends Regionally, there have been indications of changing attitudes to drug policy, linked to better understanding of the counter-productive effects of criminalisation. For instance, in its 2014 report, the West Africa Commission on Drugs (WACD), called for the decriminalisation of possession for personal use. The report provided evidence showing that criminalisation of drug use worsens health and social problems, puts undue pressure on the criminal justice system and fosters corruption.

Ghana strives for a more humane drug policy

Chairperson Eggleton, Deputy Chairperson Petitclerc, Deputy Chairperson Seidman, and other distinguished members of the Standing Committee on Social Affairs, Science, and Technology, thank you very much for the opportunity to testify before you today. I am a senior policy researcher at the RAND Corporation, where I co-direct the Drug Policy Research Center. I have studied cannabis policy for more than 15 years, and my cannabis research has been published in leading journals, such as Addiction, American Journal of Public Health, and New England Journal of Medicine. In 2016, I co-authored a book on cannabis legalization that was published by Oxford University Press.

Over the past two years, I have been fortunate enough to travel to Canada multiple times to meet with researchers and policymakers about cannabis policy and provide an objective assessment of cannabis legalization in the United States. Today, I will focus my remarks on the issue of cannabis potency. RAND does not have a formal position on cannabis policy, and it does not advocate for or against legislative bills or ballot initiatives. My goal for today is to help inform cannabis policy debates at the federal, provincial, and local levels.

A common warning for those consuming cannabis edibles—especially new users—is to “start low and go slow” to prevent overconsumption of δ-9-tetrahydrocannabinol (THC), the cannabinoid most responsible for intoxication. Today, I would like to raise the question about whether this approach should also be applied when considering the potency of cannabis products to be sold in Canada’s nonmedical market should C-45 become law.3 With a “start low and go slow” approach, regulations may start with a smaller range of legal activities and products and a tighter set of rules, allowing regulators and other decisionmakers the option to relax them over time.

For decades, Colombia has faced the challenge of promoting economic development and peace in its coca growing regions while quelling the flow of coca for unlawful purposes. During this time, the country has rarely considered promoting economic development with coca, partly because national and international frameworks and policies have written off coca growers as one of the main drivers of the drug trade.

The 2016 peace agreement marked the first significant shift towards a paradigm that prioritizes human rights, rural development, and local governance in the issue of coca. Within the context of the provisions of the peace accord, concrete policy innovations were introduced in 2017. The National Training Service (SENA), a government entity in charge of offering vocational training in vulnerable communities, a peacebuilding organization, and members of the Lerma coca-growing community formed a partnership that became the key to success in advancing policy reform.

Coca Industrialization: A Path to Innovation, Development, and Peace in Colombia

It proposes building a coca leaf industry that guarantees a sound income for farmers; provides good quality, sustainable raw materials for manufacturers; and ensures traceability, and control across the supply chain, with adherence to international laws.

 explores the potential that the coca leaf holds and sets out the parameters for a system that could significantly expand coca industrialization in a manner that makes the most of its social, political, economic, and environmental benefits.
